2. The petitioner seeks bail in Ghorasahan P.S. case No. 650 of 2023 instituted for the offences under Sections 379, 411 and 34 of the Indian Penal Code.

3. Prosecution allegation, in short, is that when the police party reached the place of occurrence, on seeing the police the accused persons tried to flee away but on chase petitioner was apprehended and another managed to flee away and one stolen motorcycle was seized.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no concern with the said

Patna High Court CR. MISC. No.18827 of 2024(2) dt.15-03-2024 2/2 motorcycle and in fact he had no knowledge that the said motorcycle was stolen one. Charge-sheet has been submitted in this case. In course of investigation, nothing concrete has surfaced against the petitioner. The petitioner is in custody since 18.11.2023 and has two criminal antecedents in which in one case he is on bail.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ghorasahan P.S. case No. 650 of 2023.
