The petitioner seeks bail in a case registered under Sections 414, 420, 467, 468, 471, 120(B)/34 of the I.P.C. Allegation is that on 20.06.2018 while the informant along with police party was on checking duty, two persons sitting on motorcycle coming from Nawsatar Mathiya and on seeing the police party they fled away, but one person was apprehended by police party with motorcycle and he does not show any paper of motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.06.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has

Patna High Court CR. MISC. No.13793 of 2019(2) dt.16-04-2019 2/2 falsely been implicated in the present case. The petitioner has remained in custody for more than six months. The motorcycle in question does not belong to the petitioner. He has no knowledge regarding the same.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th A.C.J.M., Bhojpur at Ara in connection with Bihiya P.S. case No.238 of 2018.
