JUSTICE RAJIV ROY ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner, learned counsel for the informant as also the learned APP for the State. The petitioner apprehends his arrest in connection with Deep Nagar P.S. Case No. 258 of 2018 instituted under Sections 392 of the Indian Penal Code lodged on 21.07.2018 by the informant Parmanand Pandey.

As per the prosecution story, on 21.07.2018 at about 1.30 A.M. the informant had been sleeping with his family member in his house in the mean time the son of the house owner knocked the door of the informant. When the informant opened his door, saw three four unknown persons there who pointed Pistol, entered the house made him sit in a room and they also told Saurav Kumar to sit there after that they took out cash of Rs. 30,000/-, Gold Ear-ring, Chain, Ring and Utensils

They also took R/C of vehicle Book bearing No. BR21GA- 2995 with the concerning documents and Panasonic T.V. and after committing theft they went away. All the unknown thieves were 20-30 Years. Accordingly the FIR.

Considering the fact that the matter is of 2018 and five years later the petitioner has come before this Court as also the fact that he has criminal antecedent of the same nature. Considering the aforesaid facts, this is not a fit case for anticipatory bail, accordingly the anticipatory bail application stands rejected.
