In this case, the petitioner is seeking regular bail in connection with Didarganj P.S. Case No.289 of 2019 registered for offence punishable under sections 304(B), 323, 379, 504, 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the marriage of the informant's sister was solemnized in the year 2018 and during marriage, different items of gift such as T.V., Freeze, Sikri, Super Splendor motor cycle were given and they were living happily. On 16.10.2019, the informant received an information that his sister has died and when they went to the burning ghat, Subodh Rai, Pintu Kumar, Ravindra Kumar were badly assaulted and abused by Manoj Singh Yadav (present

Patna High Court CR. MISC. No.14000 of 2020(2) dt.04-06-2020 2/2 petitioner) and Lal Bahadur Singh, who is brother of the present petitioner. Allegation has been made that they have killed the victim.

The learned counsel for the petitioner submits that the petitioner and the husband of the victim are in custody since 17.10.2019.

Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Patna City, Patna in connection with Didarganj P.S. Case No.289 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. In case of failure, the prosecution will have liberty to file an application before the court below for cancellation of his bail bond. (Shivaji Pandey, J) Mahesh/- U T
