The petitioner seeks bail in a case registered for offences under Section 38 (i)(ii) of the Bihar Prohibition and Excise Act.
It is contended that as per allegation, 244.500 litres of Nepali wine were recovered from the possession of co-accused Manoj Paswan. It is further contended that the petitioner was not apprehended from the spot and he has been implicated on the basis of confession statement of co-accused Manoj Paswan. Patna High Court Cr.Misc. No.34109 of 2017() dt.20-07-2017 2/2 custody since 23.05.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Supaul in connection with Birpur (Bhimnagar) P.S. Case No. 55 of 2017 [S.T. (Excise) - 144/2T017] with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
