1. Heard learned counsel for the petitioner, the learned counsel appearing on behalf of the informant and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 325, 504, 506 and 34 of the Indian Penal Code.

3. The learned A.P.P. at the outset submits the case diary along with injury report was called for by an order dated 18.04.2024 and the same has been received. It is next submitted that from perusal of the case diary, it manifests that the injury report of the Sadar Hospital, Sitamarhi records that injured has suffered simply injury. It is also submitted that the injury report

No.16908 of 2024(4) dt.24-07-2024 2/3 does not record that the injured was assaulted by knife, but then, submits that the injured was referred to I.G.I.M.S., Patna by the Sadar Hospital, Sitamarhi, on which the learned counsel appearing on behalf of the informant submits that since injured was assaulted by knife by the petitioner causing injury on his right cheek and head, as such, the Sadar Hospital, Sitamarhi referred the injured to I.G.I.M.S., Patna for better treatment. It is further submitted that she has a copy of the injury report of I.G.I.M.S., Patna wherein it is specifically recorded that the injured was assaulted by knife on face.

4. The the learned counsel appearing on behalf of the petitioner submits that he has a copy of the case diary but does not have a copy of the injury report of the injured from I.G.I.M.S., Patna, as such, is not aware whether the injured suffered any injury caused by knife.

Considering the submissions made by the learned counsel appearing on behalf of the informant and the injury report of the I.G.I.M.S., Patna, which records that the injured suffered knife injury on face and the fact that Sadar Hospital, Sitamarhi referred the injured for better treatment to I.G.I.M.S., Patna, as such, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

6. Accordingly, the prayer of the petitioner for anticipatory bail is rejected.
