JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner apprehends his arrest in relation to Madanpur P.S. Case No. 12/2014 registered under Sections 302/201 of the Indian Penal Code. The informant has lodged a First Information Report on recovery of dead body of his daughter whose marriage was fixed with someone else. In course of investigation, one Puja Kumari stated that on the fateful night, the deceased received a call from different mobile number on her mobile, but, it was the petitioner who was talking and it is on the basis of this and the allegation that petitioner was having illicit relationship with the deceased that he is being sought to be arrested in this case. Apart from others, there is no other material.

Learned counsel for the petitioner submits

Patna High Court Cr.Misc. No.18264 of 2015 (2) dt.11-06-2015 that this is mere hearing, there is no authentication as to whether petitioner had actually talked.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Pramod Sao @ Pramod Bhaw, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 12 of 2014, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure. (Navaniti Prasad Singh, J.) Rajeev/- U T
