The Petitioner seeks bail in AkhoriGola P.S. Case No. 110 of 2016 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-b)A, 26 and 35 of the Arms Act.
The allegation against the petitioner as per the FIR is that some persons sitting with arms were conspiring for commission of offence and when police party reached at the place of occurrence, five persons including the petitioner were arrested and a country made pistol with two live cartridges was recovered from the possession of the petitioner. It has been submitted on behalf of the petitioner that

No.33130 of 2017 (2) dt.20-07-2017 2/2 the petitioner has been sufficiently penalized by rotting in jail since, 16.10.2016, and other co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 14.07.2017 in Criminal Miscellaneous No. 31739 of 2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri (Rohtas) in connection with AkhoriGola P.S. Case No. 110 of 2016.
