ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the informant as well as the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Mahila P.S. Case No.16 of 2014 for allegedly having committed the offence under Sections 376 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire case was lodged with a view to take wreak vengeance on the family of the accused persons. However, thereafter the matter has been resolved and the girl has been married off to somebody else. It is submitted that there was a pressure within the family not to solemnize the marriage of the victim girl in
Patna High Court Cr.Misc. No.18308 of 2015 (6) dt.18-09-2015 2/2 the same family as another sister has also been married in the same family and as per the prevalent practice in the family, the same cannot be solemnized.
In view of the peculiar facts and circumstances of the case and also because now the informant has appeared and stated that she is not willing to proceed with the prosecution of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Mahila P.S. Case No.16 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
