Petitioner seeks bail in Guraru P.S. Case No. 70 of 2017 for the offence punishable under Section 366(A) of the Indian Penal Code.

The allegation against the petitioner is of kidnapping.

Informant is the uncle of the victim girl, who has alleged that the accused-petitioner had kidnapped the minor daughter of his brother for the purpose of marrying her. The girl has been recovered and in her statement under Section 164 of the Cr.P.C had said that he had gone with the accused-petitioner on her own sweet will. The Medical Board has examined the age of the girl to be 17 years as well as the court below had also

Patna High Court Cr.Misc. No.48916 of 2017(2) dt.17-10-2017 2/2 assessed her age to be 17 years.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Vth, Gaya in connection with Guraru P.S. Case No. 70 of 2017.
