The petitioner is apprehending his arrest in a case registered under sections 419, 420, 367, 368 of the Indian Penal Code.

Learned counsel for the petitioner submits that distinct allegation has been made against the petitioner that the petitioner has sold one sim card having sim card No. 9934414537 to the informant but on verification it was found that the petitioner has obtained the aforesaid sim card in his name. Considering the peculiar nature of allegation and the fact that final form of the case has been submitted only after five years, let the above named petitioner in the event of his

Tripathi, Ist Class, Judicial Magistrate, Jehanbad in Jehanabad P.S. Case No. 296 of 2005, subject to the conditions as laid down under section 438(2) Cr.P.C.
