The petitioners are apprehending their arrest in a case registered under sections 302, 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that earlier case was registered against unknown persons and after thorough investigation police submitted final form against the petitioners and on protest petition filed by the informant the petitioners have been implicated in the present case.

No.18330 of 2015 (2) dt.17-09-2015 2/2 Learned counsel for the petitioner submits that the entire case is based on suspicion and there is no cogent material on record to implicate the petitioners in the present case. It is further submitted that the petitioners have been roped in this case merely on suspicion and the complainant himself has stated that he suspected the hands of the petitioners. Since the informant is not eye witness to the present case, and the entire case is based on suspicion, the above named petitioners in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Learned Judicial Magistrate, Buxar, in Complaint Case No. 290( C ) 2011, Trial No. 1830 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C.
