2. Counsel for the petitioner submits that the petitioner is entitled for the relief of benefit of ACP in terms of official order dated 28.11.2017 in the light of the order passed by this Court vide order dated 13.05.2014.

3. Counsel further submits that his case is squarely covered from the analogous cases decided in C.W.J.C. No.9798 of 2008.

4. Counsel for the State on the other hand submits that in the year 2019, the State of Bihar has framed the Bihar Government Servant Grievance Redressal Rules, 2019 under which the petitioner has remedy to move before the competent

Patna High Court CWJC No.4242 of 2020(3) dt.15-03-2024 2/2 authority. Here in the present case, the competent authority is the Joint Secretary, Agriculture Department.

In the light of the submissions made, this writ petition stands disposed off directing the petitioner to raise his grievances before the Joint Secretary, Agriculture Department within 30 days along with the order and the Joint Secretary, Agriculture Department is directed to verify the case of the petitioner that whether his case is squarely covered under the order passed in C.W.J.C. No.9798 of 2008 or not. If it has been found that his case is squarely covered under the said decision then the relief granted to those petitioners whose writ disposed off by this Court in the year 2014, shall also be granted to the petitioner within 90 days thereafter and the petitioner shall filed his representation under Section 4(C) of the Bihar State Litigation Police, 2011.

6. With the aforesaid direction, the present writ application is hereby disposed off.
