Petitioner is apprehending his arrest in connection with Complaint Case No.177c/2017 , registered for offences punishable under Sections 5, 7 and 14 of the Saw Mill Act, 1990 and Sections 29, 32 of the Wild Life Protection Act and Sections 33, 41 and 42 of the Indian Forest Act, 1927. As per the complaint petition, the Forest Officers were petrolling, the logs were seized from the Saw Mill of the petitioner and on seeing the raiding party, the petitioner and other accused persons fled away. Apart from that it appears that he is accused in one more case. Earlier also the Saw Mill was seized.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.32176 of 2018(3) dt.25-09-2019 2/2 that he has falsely been implicated in this case and other brothers of the petitioner have been granted privilege of bail, vide order dated 22.5.2018 passed in Cr. Misc. No.24909 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Complaint Case No.177c/2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
