The petitioner has preferred this application for grant of regular bail in a case registered under sections 8/20(b)(ii) (c)/27(A) of the N.D.P.S. Act.
As per the prosecution case, 208 kg. of ganja is stated to have been recovered from the car.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. His name transpired in course of investigation when on the basis of information received from a spy, the petitioner was taken into custody and his confession was recorded by the police. No incriminating article has been recovered from his possession and he has no concern either with the alleged vehicle from which the seizure
Patna High Court CR. MISC. No.24996 of 2021(2) dt.23-11-2021 2/2 has taken place nor with the seized article. The petitioner is in custody since 31.7.2020 and chargesheeet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner being in custody for over 1 year and 3 months, the Court directs the petitioner to be enlarged on bail in connection with NDPS case no.21 of 2020 arising out of Chainpur P.S. Case no. 222 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Kaimur at Bhabua.
