In this case, the petitioner is seeking anticipatory bail in connection with Nauhatta P.S. Case No. 164 of 2017, registered for the offence punishable under Section-341, 323, 308, 504/34 of the Indian Penal Code and 3⁄4 of Prevention of Witch Practices Act. Allegation has been made that the petitioner gave iron rod blow on the mouth of informant. In such a manner, the petitioner pierced cheek of the victim.

Counsel for the petitioner submits that no such injury has been received by the victim as the order of learned Sessions Judge is completely silent on this point and moreover, both sides have restored peace. In the facts and circumstances of the case, let the petitioner namely Md. Lalo @ Md. Lalu be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six
