The petitioner seeks bail in connection with Harsidhi P.S. Case No. 312 / 2022 registered for the offence punishable under Sections 323, 341, 324, 307, 504/34 of the Indian Penal Code.
The allegation against the petitioner is that he assaulted with Dab on the head of Jaibun Nesha, mother of the informant.
Learned counsel for the petitioner submits that although there is allegation of assault on Jaibun Nesha by the petitioner but there is no injury found on her person and the allegation is falsely levelled against the petitioner. Petitioner and informant are next door neighbours and Gotiya and due to land dispute petitioner has falsely been implicated in this case. The
Patna High Court CR. MISC. No.15803 of 2023(2) dt.15-05-2023 2/2 petitioner is in jail custody since 04.12.2022 and he has no criminal antecedent.
Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 312 of 2022.
