The petitioner apprehends his arrest in Complaint Case No.3041 of 2018 registered under Sections 323, 498(A) and 406 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that opposite party no.2 has filed Maintenance Case No.99 of 2019 in which the petitioner appeared and filed his written statement. It is also submitted that the petitioner works as a labourer in a tent house and he is ready to pay Rs.1,000/- per month to his wife (O.P. No.2) till the order of maintenance

Patna High Court CR. MISC. No.24913 of 2021(3) dt.04-03-2022 2/2 case. A supplementary affidavit has been filed to this effect. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case as well as the statements made in the supplementary affidavit, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned SD.J.M., Muzaffarpur in connection with Complaint Case No.3041 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
