The petitioner seeks bail in Haspura P.S.Case No.211/17 registered under Section 394 of the I.P.C. The informant has alleged in his written complaint that while he was going from Gaya to Haspura for trade purpose by tempo, four unknown persons riding on two motorcycles looted Rs.1,06,900/- from him which he had kept in his bag, on the strength of pistol and also snatched his golden chain. It has been submitted on behalf of the petitioner that he is innocent and has been implicated only on the basis of suspicion. He has not been named in the F.I.R. and except his own confession there is no other incriminating material against the petitioner. He is in custody since 24.11.2018. Considering the facts and circumstances of the case,
Patna High Court CR. MISC. No.13828 of 2019(2) dt.14-03-2019 2/2 as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M.,Daudnagar, Aurangabad, in Haspura P.S.Case No.211/17 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s.
