2. The petitioner seeks bail in connection with Charpokhari P.S. Case No. 123/2023 registered for the offence punishable under Sections 341/323/447/307/506/302/34 of the Indian Penal Code.

3. As per the prosecution case, the accused persons, four in number, assaulted the prosecution side in which one person has died and three persons have sustained injuries. Out of them two persons are said to have sustained grievous injuries in the parietal region and the final report of the injury of the third person has not yet come. The petitioner in jail since 12.07.2023.

4. It has been argued that since other co-accused have been granted bail, this petitioner also deserves bail.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail and submitted that the deceased and the injured were assaulted in a planned manner which is apparent from the injuries sustained by the prosecution side.

6. Grant of bail to two accused in my opinion does not entitle the other co-accused bail when four persons were assaulted by the prosecution side.

7. This application is dismissed.

8. The trial Court is directed to expedite the trial. (Sandeep Kumar, J) Saif/- U T
