ANJANA MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Agamkuan P.S. Case No. 505 of 2015 registered for the offences punishable under Sections 341, 342, 323, 354, 379/34 of the Indian Penal Code.

Earlier case dairy of the present case was called for, which has since been received.

Learned counsel for the petitioners submits that actually it was a dispute between the children of the respective parties on account of the cricket game. Admittedly, the first information

Patna High Court Cr.Misc. No.13079 of 2016 (3) dt.19-05-2016 report has been lodged after a fortnight of the alleged occurrence, and no explanation has been offered for delayed filing of the same. Learned counsel after perusal of the case dairy submits that though actually, the dispute arose on account of cricket game but the same has not been mentioned in the first information report.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City in connection with Agamkuan P.S. Case No. 505 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) Jagdish/- U T
