The petitioner seeks bail in a case registered for offences under Sections 182, 389, 465, 468, 469, 471 and 120(B) of the Indian Penal Code, Sections 30 and 41 of the Bihar Prohibition and Excise Act and Sections 47, 54 and 57 of Bihar Excise Amendment Act, 2016.

It is contended that as per allegation, the petitioner along with co-accused Rajesh Kumar had conspired to implicate the Superintending Engineer, P.H.E.D., Patna by keeping two bottles of foreign liquor beneath the almirah. It is urged that

Petitioner claims that he is having clean antecedent and is in custody since 24.05.2017. Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Hawaiadda P.S. Case No. 75 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
