Having regard to the nature of allegation against the petitioner for the offences punishable under Sections-302, 201/34 of the Indian Penal Code and Section-3(2) (v) of the Scheduled Caste and Scheduled Tribe Act, and the admitted position that there is no allegation of any specific overt act against the petitioner, this Court taking into account the submission of learned counsel for the petitioner that co-accused Ramesh Rai and Ram Bharosha Rai, having identical allegation have already been granted regular bail by this Court, by order

Patna High Court Cr.Misc. No.18877 of 2015 (4) dt.20-08-2015 dated 24.06.2015 in Cr. Misc. No. 17819 of 2015 and Cr. Misc. No. 21992 of 2015, would direct the petitioner Dhananjay Rai to surrender before the Court below and make a prayer for regular bail, and if the Court below finds that the case of the petitioner is also identical to that of the case of aforesaid co-accused Ramesh Rai and Ram Bharosha Rai, the petitioner shall also be granted regular bail.

With the aforementioned observation and direction, this application is disposed of.
