JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-04-2016 The instant writ petition has been filed by the petitioner for issuance of direction commanding the respondents to investigate and conclude the investigation of the case in correct direction.

A counter affidavit has been filed on behalf of respondent no.5 wherein it has been stated that after proper investigation and supervision by the senior officer, the case was found true against the accused, Anil Kumar Thakur, Munna Kumar Yadav, Laxman Chaubey @ Baba, Krishna Kumar

Patna High Court Cr. WJC No.416 of 2015 (3) dt.28-04-2016 2/2 Dwivedi and Mithilesh Tiwari. The aforesaid accused persons have either been arrested or have surrendered in the court. It has been further contended that charge-sheet has already been submitted against the aforesaid accused persons and the supplementary investigation is going on.

After having perused the contents of the counter affidavit, learned counsel for the petitioner Mr. Madhu Prasun seeks leave to withdraw the present application. Leave is granted.

The application is dismissed as withdrawn.
