JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 02-04-2025 Learned counsel for the petitioners submits that anticipatory bail petition with respect to Petitioner No. 1, Rampravesh Yadav has become infructuous as he has already been arrested.

2. Accordingly, anticipatory bail petition with respect to Petitioner No. 1 is dismissed as withdrawn having become infructuous.

3. Heard learned counsel for Petitioner Nos. 2 and 3 and learned A.P.P. for the State.

4. Petitioner Nos. 2 and 3 apprehend their arrest in

Patna High Court CR. MISC. No.14865 of 2025(2) dt.02-04-2025 2/3 connection with Magadh Medical P.S. Case No. 221 of 2024, instituted under Sections 74, 109, 115, 117, 112, 303, 352, 3(5) of B.N.S., 2023.

As per the prosecution case, on the date of occurrence while informant was going to shop for purchasing some articles, petitioners along with other accused persons armed with weapons came there and started abusing her and also threatened to kill her. The accused persons also assaulted the informant. On hulla, her family members came to save her then all the accused persons assaulted the family members of the informant. Petitioner Nos. 2 and 3 are alleged to have assaulted the brother-in-law and sister-in-law of the informant.

6. Learned counsel for Petitioner Nos. 2 and 3 submits that petitioners are innocent and have falsely been implicated in this case. Petitioners and informant are Gotia having family dispute due to which there is case and counter case between the parties in which both parties have got injuries. Allegation against Petitioner Nos. 2 and 3 is general in nature. Injuries caused by them are not on the vital part of the body. There is delay of 20 days in filing the F.I.R. Petitioner Nos. 2 and 3 have no criminal antecedent. Petitioner Nos. 2 and 3 undertake to cooperate in the investigation and trial.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner Nos. 2 and 3 be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Vth, Gaya in connection with Magadh Medical P.S. Case No. 221 of 2024, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
