The petitioner is apprehending arrest in a case registered for the offences punishable under sections 143,341,353 and 506 of the Indian Penal Code.
The prosecution case is that the informant being a police officer reached to the village Ithori Bhuitoli and made attempt to seize fermented Mahua kept in seven jars but the petitioner along with 25-30 associates started abusing the informant and gave threatening and thereby they obstructed the informant in discharge of official duty.
It is submitted by the learned counsel for the petitioner that no seizure was made nor any injury was caused to
Patna High Court Cr.Misc. No.12567 of 2016 (2) dt.17-03-2016 2/2 anyone. More over, the accusation does not suggest that any force was used.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Alipur P.s. Case No. 114 of 2015 pending in the court of learned ACJM VII, Gaya. This application is disposed of with the aforesaid observation/direction.
