ANJANA MISHRA ORAL ORDER 24-09-2015 Learned counsel for the petitioners submits that a supplementary affidavit has been today, but on account of paucity of welfare stamp, the same deficit is still there, which he shall file later.
Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner No.2, namely, Ashis Kumar, has already been taken into custody and, therefore, learned counsel for the petitioners seeks liberty to withdraw the application on his behalf. It is, accordingly, dismissed as withdrawn. Now, Petitioner No.1 Bhawani Kumar is apprehending his arrest in connection with Tikkapatti P.S. Case
Patna High Court Cr.Misc. No.18350 of 2015 (4) dt.24-09-2015 2/2 No.7 of 2015 for allegedly having committed the offence under Sections 363/366/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the girl in question has now been recovered and she has not taken the name of Petitioner No.1.
Considering the aforementioned facts and circumstances and also that petitioner No.1 has no criminal antecedents, let petitioner No.1, namely, Bhawani Kumar, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri P. Kumar, learned Judicial Magistrate, 1st Class, Purnia, in connection with Tikkapatti P.S. Case No.7 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
