The petitioner seeks bail in Sessions Trial No. 328 of 2017, arising out of Hathuwa P.S. Case No. 101 of 2016, registered under Sections 326, 307 and 34 of the Indian Penal Code.
The petitioner is alleged to have sprinkled petrol on the body of Faiyaz Ansari, son of the informant and son of the petitioner ignited fire causing burn injury.
Prayer for bail of the petitioner was earlier rejected vide order dated 13.12.2016 passed in Cr. Misc. No. 37362 of 2016 with an observation that the petitioner may renew his prayer for bail after remaining one year in custody. It is submitted that the petitioner is in jail since
Patna High Court Cr.Misc. No.36403 of 2017 (2) dt.30-08-2017 28.05.2016. The petitioner has already remained in jail for 15 months.
Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than 15 months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Gopalganj in Sessions Trial No. 328 of 2017, arising out of Hathuwa P.S.
