JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-07-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Gwalpara P.S. Case No. 78 of 2019, registered under Sections 147, 341, 323, 379, 385, 384 and 504/34 of the Indian Penal Code.
The accusation is that 10 persons named in the FIR including the petitioners along with 30 to 35 unknown variously armed with weapons entered in the house and shop of informant, Asha Devi, and took ornaments and cash of Rs.10,200/-.
Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.12853 of 2020(2) dt.03-07-2020 2/2 petitioners and the informant are co-villagers and due to dirty village politics, the informant lodged the present case with false allegation. Further submission is that earlier the informant had also lodged Gwalpara P.S. Case No. 42 of 2019, as detailed in paragraph 3 of the petition, in which case, petitioner is on bail. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Udakishunganj, Madhepura, in connection with Gwalpara P.S. Case No. 78 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
