The petitioner who retired from service on 31.12.2019 on attaining the age of superannuation from the post of teacher in Utkramit Middle School, Dharanipatti, Mohanpur, Samastipur has filed this writ petition for payment of petitioner's retirement benefits including pension, gratuity, leave encashment, salary, etc.

3. Respondent Nos. 2 & 3 have filed a counter affidavit, wherein, in paragraph-11 it has been stated that the Group Insurance and the G.P.F. amount of the petitioner have already been paid. It is

Patna High Court CWJC No.4450 of 2022 dt.16-04-2024 2/2 further stated in paragraph-13 of the counter affidavit filed by the respondent Nos. 2 & 3, that the entire retiral benefits of the petitioner will be paid within a period of two months.

4. Though, the counter affidavit was filed in the year 2022, learned counsel for the petitioner submits that despite such averments being made for payment of entire retiral benefits to the petitioner within a period of two months, the petitioner has not yet been paid the entire retiral benefits.

5. Under the circumstances in view of the averments made in paragraph-13 of the counter affidavit filed by the respondent Nos. 2 & 3, this writ petition is hereby disposed of with a direction to the respondents, more particularly the respondent No. 3, to pay to the petitioner his entire retiral benefits along with admissible statutory interest within a period of two weeks from today, if not already paid.

6. The writ petition is disposed of with the above directions.
