Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with

Patna High Court Cr.Misc. No.18371 of 2015 (3) dt.02-07-2015 2/3 Magadh University P.S. Case No.15 of 2015 registered under Sections 147, 149, 295(A), 188, 153(A), 120(B) and 427 of the Indian Penal Code.

The accusation against the accused petitioners, named in the F.I.R., and 30-40 unknown is of throwing the mud on the cloths of the informant and assaulting him and others when they were going to offer prayer of Friday (Juma) and also throwing colour on the Madarsa on the day of holi festival. Learned counsel appearing on behalf of the petitioners submits that, in fact, Meena Devi, the wife of the co-accused, Mukhi Yadav, alongwith her son was going to Vishnupad Temple on a motorcycle, in the way, the informant of the present case and others caused assault to her and her son regarding on the basis of the written report of Meena Devi, Magadh University P.S. Case No.16 of 2015 was instituted on 07.03.2015 against the brother of the informant and 15 others under Sections 147, 149, 341, 323, 379, 354, 504 and 506 of the Indian Penal Code. It is also submitted that all the accused persons of the case lodged by Meena Devi have surrendered in the court of the Chief Judicial Magistrate, Gaya.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest

Patna High Court Cr.Misc. No.18371 of 2015 (3) dt.02-07-2015 3/3 or surrender by them within four weeks, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Magadh University P.S. Case No.15 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
