The petitioner is languishing in custody since 09.10.2018 in a case registered for the offences punishable under Sections 307, 504, 506/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The prosecution case is that the petitioner along with other co-accused, Mahabir Singh came to the agricultural field of the informant and started abusing him and alleged him to be a police informer. It is further alleged that the petitioner also gave life threat to the informant and resorted to fire upon him but it

Patna High Court CR. MISC. No.17302 of 2019(2) dt.27-03-2019 2/2 did not hit him. On hearing the sound of gun shot when nearby people came, the petitioner along with other co-accused person escaped from the scene.

It is submitted by learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled against the petitioner. It is further submitted that the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is accused in three other cases but in two of those cases he is on bail.

Learned APP for the State submits that the accusation is specific against the petitioner.

Considering the nature of accusation and the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Munger in connection with Harinmar P.S.
