JUSTICE MADHURESH PRASAD ORAL ORDER 21-11-2019 Petitioner has filed the writ petition claiming relief that respondents-authorities be directed to pay /apportion half of retiral benefit payable to respondent no.5 as he has abandoned the petitioner (wife) and is living with another lady. Counsel for the State points out that entitlement of the petitioner is determined under order dated 16.09.2008 passed in Cr. Revision no. 900 of 2007 (Annexure 2 of writ petition). Petitioner's entitlement stands decided from bare perusal of said order (Annexure 2 of writ petition). No case is made out for issuing direction in respect of apportionment of half of retiral dues payable to respondent no.5.

Patna High Court CWJC No.5902 of 2016(2) dt.21-11-2019 2/2 Petitioner however, would be at liberty to take steps in accordance with law.

Writ petition is dismissed.
