JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 14.10.2017, seeks bail in Tarabari PS Case No. 81 of 2017 registered under Section 392 of the IPC.
The allegation in brief is that while the informant was coming back to home after withdrawing money from the bank she was relieved of the money by the petitioner and his associates. Learned Counsel for the petitioner submits that the FIR was lodged after delay of two days; during investigation it transpired that on the date of alleged occurrence no withdrawal was made by the informant from the Bank so the petitioner has been falsely implicated as there was some dispute relating to payment of money between the informant's brother and the petitioner's father, moreover the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Md. Tanweer @ Tanweer is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Araria in connection with Tarabari PS Case No. 81 of 2017.
