The petitioner seeks bail in a case instituted for the offences under Sections 420, 489(A), 489(B), 489(C) and 34 of the Indian Penal Code.

The prosecution case in short is that the counterfeit currency were recovered from the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.1.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against the co-accused Manoj Kumar. The name of the petitioner has transpired on the basis of confession of coaccused namely Manoj Kumar. There is no recovery of

Patna High Court CR. MISC. No.12756 of 2020(2) dt.06-03-2020 2/2 counterfeit currency from the possession of the petitioner. Rs. 6300 of counterfeit currency is said to have been recovered from the co-accused Manoj Kumar. Other co-accused namely Manoj Kumar has been granted bail vide order dated 25.04.2018 passed in Cr. Misc. No. 10166 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 169 of 2017.
