The petitioner seeks regular bail in connection with G.R.Case No.2150 arising out of Muffasil P.S.Case no.280/2000, registered for offences punishable under Sections 25(1-b)A/26 of the Arms Act.

This case is for misuse of bail for 13 long years as the bail bond of the petitioner was cancelled in the year, 2005 and he has been declared absconder in the year, 2012. Submission of the learned counsel for the petitioner is that as his lawyer was suffering from cancer so he could not make pairvi. Petitioner is in custody for six months and he is aged about 75 years as well as he is ready to abide by any condition imposed upon him.

Having heard both sides and in view of the facts and circumstances, as stated above, especially considering the age of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Munger in connection with G.R.Case No.2150 of 2000 arising out of Muffasil (Bariarpur) P.S.Case No.280 of 2000, with condition that he will appear before the learned trial court as and when required otherwise his bail bond shall be cancelled..

With the aforesaid direction, this application is allowed.
