The petitioner is in custody since 04.01.2017 in connection with Nawada Town P.S. Case No. 716 of 2016 for the offence registered under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner's name has surfaced on the basis of the confessional statement made before the police by the co-accused, which has no evidentiary value. It is further submitted that similarly situated coaccused person has been extended the privilege of bail under identical circumstances in Cr. Misc. No. 10204 of 2017 vide order dated 20.03.2017.

No.33243 of 2017 (3) dt.21-09-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Towan P.S. Case No. 716 of 2016.
