ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the opposite party No. 2. The petitioner as well as opposite party No. 2 are present in Chambers today.

Supplementary affidavit containing terms of compromise between the parties is being filed in the Court today on behalf of the parties. On perusal of the same, it indicates that some sort of settlement has been arrived at between them by which they have agreed to part ways and also to withdraw all pending cases. The parties have further agreed to file a divorce petition before the appropriate court seeking termination / dissolution of their

Patna High Court Cr.Misc. No.18975 of 2015 (10) dt.31-08-2016 P2/2 marriage within a period one month from the date of settlement. Opposite party No. 2 has also received the drafts presented by the petitioner and has nothing more to say. The terms of the compromise petition which is being filed today is being kept on record.

In view of the aforementioned facts and circumstances and the compromise petition, the present case is being disposed of. As such, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Katihar, in connection with Katihar Mahila P.S. Case No. 42/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
