This is an application for bail in connection with Bhaptiayahi P.S.Case No. 82 of 2016 registered for the offences punishable under Sections 419, 420, 483, 486 of the Indian Penal Code and 103/104 of Indian Trade Mark Act, including 63, 64, 65 of Copy Right Act.
Allegation against the petitioner is of recovery of duplicate medicine, empty bottles and stickers of some other companies from the shop of the petitioner and it is alleged that he has manufactured duplicate medicines.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for three months and he is ready to abide by any condition that may be imposed by this Court on him, if bail is granted and further
Patna High Court Cr.Misc. No.51458 of 2017 (3) dt.16-11-2017 2/2 submission is that charge sheet has been submitted in this case. Heard learned APP also.
Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Bhaptiayahi P.S.Case No. 82 of 2016, subject to the following conditions :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) If involvement of the petitioner in such type of cases is found in future, the prosecution will be at liberty to move for cancellation of his bail bond.
