The petitioner, who is in custody, seeks bail in connection with Lauriya P.S. Case No. 80 of 2016 registered for the offence punishable under Section 394 of the Indian Penal Code.

Informant has stated in his fardbeyan that on 06.06.2016 he went with his relative Rajesh Gupta on cycle to Lauria State Bank to withdraw the money and withdrew Rs. 31,000/- and Rs. 1 lac and while returning to home at 12.15 PM four miscreants on two motorcycles stopped and assaulted them and on point of pistol snatched the cash money and thereafter they fled away.

No.6354 of 2018(3) dt.28-02-2018 2/2 Learned counsel for the petitioner submitted that he is not named in the FIR, his name has surfaced on the basis of confessional statement made by co-accused Sadare Alam and nothing has been recovered from his possession and similarly situated co-accused, persons, namely, Lauddu Ansari and Kalam Ansari have already been granted bail by this Hon'ble Court as contained in Annexure-2. It has further been submitted that petitioner is in custody since 16.11.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Bettiah, District- West Champaran, in connection with Lauriya P.S.
