The petitioner is apprehending his arrest in connection with Amarpur P.S.Case no.112 of 2018 , registered for offences punishable under Sections 7 of the E.C. and Section 419, 420, 120(B) of the Indian Penal Code.

Allegation as per FIR is that a Pick-up Van along with 80 bags of rice has been recovered and the petitioner is a rice miler. Submission of the learned counsel for the petitioner is that it has falsely been said that the seized rice is subsidized rice and he has been falsely implicated in this case. It is further submitted that he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.13816 of 2019(2) dt.06-03-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Banka in connection with Amarpur P.S.Case nO.112 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation and it is also made clear that if any serious incriminating materials is found out during the investigation, the prosecution is at liberty to move for cancellation of his bail bond before the learned court below itself.

Let a copy of this order be sent to the S.P., Banka also. With the aforesaid observation, this application is allowed.
