The present application has been filed for modification of order dated 25.01.2023 passed in Cr. Misc. No. 575 of 2023.

Learned counsel for the petitioner submits that the petitioner is poor person and he is unable to deposit Rs. 50,000/- (Rupees Fifty Thousand) in the PM Cares Fund, as mentioned in paragraph No. 5 of the order dated 25.01.2023. Perused the order dated 25.01.2023, the modification application and heard learned counsel for the petitioner. The petitioner was granted bail on 25.01.2023, on the submission of learned counsel for the petitioner that the petitioner is agreed to

Patna High Court CR. MISC. No.23721 of 2023(2) dt.12-04-2023 2/2 deposit the aforesaid amount and now he submits that he is unable to do so. The offer was offered by learned counsel for the petitioner himself.

In that view of the matter, I am not inclined to modify the earlier order dated 25.01.2023.

Accordingly, this modification application is dismissed.

However, if the petitioner surrenders before the learned court below within six weeks from today and prays for regular bail the learned court below would be obliged to pass the order in accordance with law on the same day without being prejudiced by this order.
