====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.1.2018, seeks bail in Turkauliya PS Case No. 432 of 2017 registered under Sections 147, 148, 149, 323, 324, 307, 504 and 379 of the IPC. The allegation in brief is that the accused persons alleged that the informant's mother practices witchcraft and in that pretext they assaulted the informant and others, allegation against the petitioner is that he assaulted with iron rod causing injury just below the eye and also assaulted over shoulder of the informant.

Learned Counsel for the petitioner submits that the injuries found on the person of the informant are simple in nature, both sides are neighbours of each other and the petitioner has no criminal antecedent except one case under the Excise Act. Having considered the said facts and circumstances, the petitioner, namely, Bodha Yadav @ Bodha Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Turkauliya PS Case No. 432 of 2017.
