Petitioner, already in custody, seeks bail in connection with Barauni Rail P.S. Case No.215 of 2017, registered under Sections 379 and 411 of the Indian Penal Code. Allegation in brief is that the petitioner was caught red handed while committing theft of a suitcase of the informant from the rail bogie.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case, he was also a copassenger and on mere suspicion, he was apprehended; whereas learned counsel for the State submits that the petitioner has also criminal antecedent of similar nature.

Having considered the said facts and circumstances, the

Patna High Court Cr.Misc. No.12790 of 2018(2) dt.05-03-2018 2/2 prayer of bail of the petitioner is rejected in connection with Barauni Rail P.S. Case No.215 of 2017, pending in the court of learned ACJM, Railway, Barauni.

However, the petitioner may renew his prayer of bail after three months of the framing of the charge, if the trial does not conclude.
