JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code, section 12 of Protection of Children from Sexual Offences Act and section 3(1)(x)(xii)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the petitioner and another entered into the house of the informant and attempted to commit rape but on alarm being raised the accused persons escaped from the scene.

It is submitted by the learned counsel for the petitioner that for the occurrence of 5.12.2015 the FIR was registered on

Patna High Court Cr.Misc. No.12806 of 2016 (2) dt.29-03-2016 2/2 10.12.2015. The impugned order reflects that the petitioner was taking snap of Guria Kumari whose mother was informed by the informant and consequently the petitioner slapped the informant when as a retaliatory measure the present case has been registered. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Siwan Mahila P.S. Case No. 197 of 2015 pending in the court of learned Ist Additional District Judge cum Special Judge, Siwan This application is disposed of with the aforesaid observation/direction.
