JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the respondents.

The petitioner is an L.T.I.S. consumer.

It is the case of the Board that the petitioner was found committing theft of energy, as such he was served a total punitive bill of Rs. 2,30,864/-.

The petitioner submits that the punitive bill recorded against, is bad in law as well as on facts.

It appears that the petitioner has not filed any objection under Section 126(3) of the Electricity Act, though provisional assessment order was served on him. In my view, the petitioner will take all his points in

Patna High Court CWJC No.19339 of 2013 (2) dt.18-09-2015 2 / 2 objection under Section 126(3) of the Electricity Act before the Assessing Officer. In case, any objection is filed the same would disposed of within a period of four months. It will be open for the petitioner to make a prayer with respect to interim relief. This application stands disposed of.
