Petitioner, already in custody, seeks bail in connection with Warisnagar P.S. Case No.161 of 2017 registered under Sections 201, 302 and 328/34 of the Indian Penal Code. Allegation in brief is that the petitioner and others assaulted the husband of the informant, poisoned him and thereafter brought him to hospital.
Learned counsel for the petitioner submits that the petitioner is the brother of the deceased and on account of property dispute, the false allegation is levelled, there is no eyewitness to the occurrence except the conclusion given by the supervising officer and that is not a piece of evidence; whereas
Patna High Court Cr.Misc. No.17102 of 2018(7) dt.09-07-2018 2/2 the learned counsel appearing on behalf of the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances, petitioner Rajesh Yadav @ Rajesh Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Warisnagar P.S.
