JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-04-2015 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing of the order dated 17.01.2015 passed in Cr. Misc. Case No. 808 of 2014 by the Subdivisional Magistrate, Hilsa in a proceeding under Section 144 of the Code of Criminal Procedure.

In my view, the application is misconceived as no order passed under Section 144 of the Code of Criminal Procedure shall remain in force for more than two months from the making thereof. The impugned order in the present case has been filed on 17th Jan, 2015. It has lost all its force after expiry of two months

Patna High Court Cr.Misc. No.18410 of 2015 (2) dt.28-04-2015 P2/2 on 17.03.2015.

Accordingly, this application is disposed of as infructuous. It is made clear that any observation made in the aforesaid order dated 17.01.2015 shall have no bearing on any pending or future proceeding between the parties.
