The petitioner seeks bail in a case registered for offences under Section 414 of the Indian Penal Code and Sections 30 (a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016.

It is contended that two persons including the petitioner tried to escape seeing the police party but on chase the petitioner was apprehended by police and allegedly on his confession 577 pouches each containing 200 ml of countrymade liquor, 516 bottles each containing 180 ml of foreign liquor and 79 bottles each containing 375 ml of foreign liquor

Patna High Court Cr.Misc. No.36551 of 2017(2) dt.10-08-2017 2/2 were recovered from the agricultural field. Petitioner claims that he is having clean antecedent and is in custody since 07.05.2017.

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas at Sasaram in connection with Sasaram (T) Muffasil P.S. Case No. 617 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
