The petitioner seeks bail in connection with Athmalgola P.S. Case No. 283 of 2022 dated 07.10.2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

As per prosecution case, the accused persons assaulted the informant by country made pistol and looted bag containing two mobiles, Aadhar Card, Pan Card, Voter Card, RC Smart Card, Two A.T.M. Cards etc.

Learned counsel for the petitioner submits that petitioner has no concerned with the alleged recovery of mobile and no Test Identification Parade has been conducted to identify

Patna High Court CR. MISC. No.20275 of 2023(2) dt.17-05-2023 2/2 the petitioner. The confessional statement has been made by the police has no evidentiary value in the eye of law. Petitioner is in jail custody since 09.10.2022, having one criminal antecedent in which he is on bail.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, Patna in connection with Athmalgola P.S. Case No. 283 of 2022.
